Politician Rose Mbithe Mulwa, her two children and two police constables have denied charges over the murder of prominent Nairobi lawyer Mathew Kyalo Mbobu.

The five appeared before the Kibera High Court on Tuesday, where they pleaded not guilty to the murder charge before Justice Diana Kavedza.

The accused are Mulwa, her children Chris and Angela, and police constables Julius Kipkoech Cheruiyot and Kennedy Kipkemoi Borboroi.

According to the charge sheet, the five, jointly with other persons who have not been presented before the court, are accused of murdering Mbobu on September 9, 2025, at approximately 7:30 pm along Magadi Road in Karen, within Lang’ata Sub-County, Nairobi.

Mbobu was an advocate of the High Court, university lecturer and author.

Following the pleas, the prosecution indicated that it would oppose the release of the five accused persons on bond.

The court directed the prosecution to file an affidavit setting out its opposition to their release pending trial.

Justice Kavedza scheduled the hearing of the bond application for November 24, 2026, when the court is expected to consider whether the accused should be released as the case proceeds.

The bond hearing will determine the question of their release pending trial; it is separate from the determination of the murder charge.

The prosecution also informed the court of its intention to charge Police Inspector Kenneth Sang in connection with the same murder.

According to the information presented, Sang was arrested in Eldoret and appeared before the Milimani Law Courts on Monday. Investigators obtained orders allowing him to be detained for 14 days while the Directorate of Criminal Investigations (DCI) continues its investigations.

The information provided does not indicate that Sang was among the five who pleaded not guilty before Justice Kavedza.

The case is the second murder prosecution involving Mulwa and her two children, who are also charged in connection with the killing of Dr Victoria Mutiso.

The proceedings over Mbobu’s death will continue as the court considers the bond application and investigators pursue inquiries into the alleged involvement of other suspects.

All five accused persons are presumed innocent unless and until proven guilty by a court of law.
