The Director of Public Prosecutions (DPP) has charged Ikanga/Kyatune Ward Member of County Assembly (MCA) Cyrus Kisavi Musyoka with two additional counts of stealing in connection with the alleged theft of smartphones in Nairobi's Central Business District (CBD).

Musyoka appeared before Principal Magistrate Geoffrey Onsarigo at the Milimani Law Courts, where he pleaded not guilty to both charges of stealing, contrary to Section 268(1), as read with Section 275 of the Penal Code.

The first charge relates to an incident on September 14, 2026, when 20 Samsung A07 smartphones valued at KSh420,000, belonging to Ezekiel Kamau Gichuki, were allegedly stolen from Chania Genesis Limited offices along River Road in Nairobi's CBD.

In the second count, Musyoka, alongside accomplices who are yet to be arraigned, is accused of stealing 126 Itel A200 mobile phones valued at KSh1,801,000. The phones belonged to Simon Gitonga and were allegedly stolen on August 18, 2026, from North Rift Shuttle offices along Mfangano Lane.

The two additional charges involve 146 smartphones with a combined stated value of KSh2,221,000.

Third smartphone theft case

The latest charges come days after Musyoka, on November 3, 2026, pleaded not guilty to a separate charge involving the alleged theft of 42 Itel City 200 smartphones valued at KSh609,000.

The handsets, each valued at KSh14,500, were allegedly stolen from a shop owned by Dahir Adan Mohamud on August 5, 2026.

Musyoka is therefore facing three separate theft cases involving smartphones with a combined stated value of KSh2,830,000. He has pleaded not guilty to the charges outlined in the proceedings.

Prosecution opposes release on bond

The prosecution opposed his release on bond, citing the seriousness of the allegations and his previous failure to attend court, which had led to warrants of arrest being issued against him.

The court was also informed that the MCA was required to appear before the Makadara Law Courts to answer separate criminal charges.

In his plea for lenient bail terms, Musyoka told the court that he was responsible for three minor children and had official duties as an elected representative of Ikanga/Kyatune Ward in the Kitui County Assembly.

He maintained that he was not a flight risk, arguing that his place of residence was known to the police.

Court sets dates for further proceedings

The court ordered that Musyoka be held at Kamukunji Police Station until November 6, 2026, when he is expected to appear before the Makadara Law Courts for plea-taking in another case.

He is expected to be transferred to Industrial Area Remand Prison thereafter, pending the court's ruling on his bail applications in the three cases.

The ruling on the bail applications is scheduled for November 18, 2026.

The allegations remain before the courts, and Musyoka is presumed innocent unless proven guilty.
