The High Court has confirmed that former Kiambu Governor Ferdinand Waititu is now a free man after his bail terms were reviewed pending the determination of his appeal in the Ksh. 588 million roads graft case.
During a court session on Thursday before the Anti-Corruption and Economic Crimes Division, Waititu’s lawyer, Jeremy Njenga told the court, “I am holding brief for the appealant who is now a free man.”
Last month, Waititu received a reprieve when the High Court granted his application to review the bail terms, reducing the amount to Ksh. 20 million, pending the appeal.

In a ruling delivered on February 18, 2026, Justice Winfrida Okwany allowed the variation, setting bail at Ksh. 20 million in cash or two sureties with property worth at least Ksh. 30 million each, subject to verification by the Deputy Registrar.
The former governor had previously faced challenges securing the bank guarantee initially required for his release. The defense argued that, seven months after the ruling, Waititu had complied with attending all court sessions and is not a flight risk. They urged the court to consider the reasonableness of the bail terms rather than the technical bank guarantee requirement.
The DPP opposed the review, stating that the defense had not provided new or compelling reasons to amend the original bail conditions. It also noted inconsistencies in the application, including the reintroduction of bail terms previously abandoned.
Waititu is to deposit his passport with the court while his appeal is pending, ensuring he remains available for all legal proceedings.
